1) Physical condition denotes special medical needs of a dog due to injury, disease, illness, age, or breed that the owner or handler should be reasonably aware.  Inclement weather is defined as weather that is likely to adversely affect the health or safety of the animal.  Dogs left outdoors mean a dog that is incapable of readily entering a building or permanent structure that complies with standards.

2) Any person with custody or control of a dog that is left outdoors shall provide it with shelter appropriate for its breed, physical condition, and climate.  Knowingly violating this is punishable by a fine of fifty to one hundred dollars for the first offense.  Subsequent violations are punishable by a fine of not less than one hundred dollars and not more than two hundred and fifty dollars.  Any offense allows for a period of seventy two hours before a second offense can be levied.

3) Minimum Standards for shelter shall include shade to protect the dog from direct sunlight, have a waterproof roof, be structurally sound and have insulation that is appropriate to local climate, allow the dog to stand up, turn around, and lie down with its limbs outstretched, and allow for the shelter to be cleaned of waste and debris.

5) If violations have been found and the dog(s) was not voluntarily surrendered will be returned when the violations have been removed.
